Heroin Charge in East Brunswick Township

The heroin problem has been described as an epidemic and East Brunswick is affected just like any community. The potential consequences are even worse if the charge involves selling, distributing or possession with intent to distribute heroin. The following are some of heroin offenses that often arise in East Brunswick:

  • Possession of Heroin Under N.J.S.A. 2C:35-10. It is illegal to possess heroin in NJ under this law. A violation is a third degree crime punishable by up to 5 years in prison, a $35,000 fine and a driver’s license suspension of six (6) months.
  • Distributing or Selling Heroin Under N.J.S.A. 2C:35-5. A charge for distribution of heroin can range from a third degree to a first degree crime. First degree heroin distribution carries up to 20 years in prison and a fine of $500,000. A second degree conviction for selling heroin results in 5-10 years in prison and a maximum fine of $150,000. Distributing heroin in the third degree triggers 3-5 years in prison and a potential fine of $75,000.
  • Possession of a Hypodermic Needle or Syringe Under N.J.S.A. 2C:36-6. This is a disorderly persons offense that results in a maximum fine of $1,000, up to six months in the county jail and a mandatory license suspension of six months.

When someone is charged with distribution and the conduct allegedly occurred in a school zone or a public park, they face enhanced penalties beyond what is provided in N.J.S.A. 2C:35-5. The biggest enhancement is the requirement at the time of sentencing that a mandatory minimum period of incarceration be imposed by the court. This is what is commonly referred to as a mandatory minimum term or period of parole ineligibility.
